Terms & Conditions
Definitions
Posting - is an advertisement or auction, placed on
Waterexchange under these Terms and Conditions.
Duration – is the number of days for which the Posting will be listed
Item – is any single subject that the Seller wishes to auction
(see exclusions)
Seller - is a private individual or company being the owner of
the Item
Buyer – is any individual over 18 years of age or a company who
offers to buy the Posting item
Terms
1. By placing an Item as a Posting, the Seller is agreeing that they
will offer to sell that Item to a Buyer. By offering to buy an Item, a
Buyer is recognising that they have a responsibility to buy the item for
the amount they have offered. Neither the Seller nor the Buyer are
entering into a legally binding contract in reference to the selling and
buying of the Item.
2. Waterexchange acts as a facilitator only, allowing Sellers and Buyers
to meet. Waterexchange is not a party to any contract nor collateral
contract for sale of the Item, which is a matter between the Seller and
Buyer alone and makes no warranty regarding any Item purchased or
obtained through this service.
3. All Sellers offering an Item for sale must be legally entitled to
sell the Item and the Item must be accurately described.
4. Waterexchange has no control over or responsibility for the quality,
safety, or legality of any Item, the ability of the Seller to sell the
Item or the Buyer's capability to pay for the Item.
5. Waterexchange reserves the right to delist the Item early or to
extend the Duration at its absolute discretion.
6. The Seller must contact the Buyer within 48 hours of receiving their
details and failure to do so may result in the Seller losing their right
to participate in Waterexchange
7. Waterexchange cannot guarantee that any Buyer will be interested in
any Item.
8. Waterexchange offers this service on the basis that the Sellers and
Buyers comply with these Terms and Conditions and act in good faith,
reasonably and co-operate in all steps throughout the operation of this
scheme.
9. Waterexchange is not responsible for any loss or inconvenience caused
by technical difficulties under its direct control or otherwise.
10. Waterexchange shall not be liable for any failure to perform its
obligations under this scheme caused by matters beyond its control.
11. Waterexchange reserves the right to close down and withdraw from
this service at any time without giving reason.
12. English law shall apply to this service and all parties submit to
the exclusive jurisdiction of the English courts in relation to any
disputes arising out of the scheme.
Exclusions:
In addition to Term 3., the following may not be Posting Items:
Any Item for which ownership or retail is illegal under English law,
including but not limited to stolen goods, contraband, items breaching
copyright laws.
